(Update: Bar exams results finally released please see results below . . . ) Rumors have it that the 2009 Philippines bar exams will be released tonight, Friday March 19, 2010. As you all know the Philippine bar exams is the hardest exam in the country. It is probably 100 times harder than undergoing gmat prep. According to rumors, initially only about 17 % of the 6,079 bar candidates has passed. However, the Supreme Court has deliberated on the matter and is said to have raised the passing percentage to more than 20 %. This is good news to all 2009 Philippine Bar Exam candidates if indeed this is so. To all who will pass the 2009 Philippine Bar Exam, congratulations in advance! The sad state of the Philippine Justice system
I ranted about the inefficiency of the Philippine Justice system in a post I wrote 2 years ago entitled “Inefficiency, the mother of all injustice.” Now, I have something to write again about the sad state of the Philippine Justice system. I received an order in November of last year that one of our cases which was originally set for November 26 was moved to January 28, 2010. Let me state verbatim the reason why the case was postponed (I found myself snickering when I received the order) “. . . In view of the attendance of the undersigned relative to the seminar on Speedy Trial and Disposition of Cases for Selected Regional Trial Court and Municipal Trial Court Judges in the Visayas on November 26, 2009 at the Marco Polo Plaza Cebu, the hearing for November 26, 2009 is hereby CANCELLED and RESET to January 28, 2010 at 8:30 oclock in the morning. . . ” Ha ? Another suggestion on Mandatory Legal Services (MLAS) otherwise known as Bar matter 2012
Five days ago, I posted the article which I submitted to the IBP Cebu City chapter entitled "A better alternative to Bar Matter 2012." This concerns the Mandatory Legal Service imposed upon lawyers by the Philippine Supreme Court. I honestly don't know what the position of the other lawyers are on this since I was not able to attend the IBP forum regarding this matter. Today, when I opened my email, I read a forwarded message from one of my lawyer friends. The article is also about the Mandatory Legal service (MLAS). I agree with the author's position on MLAS, that is why I offered to help circulate this article by posting it in my blog. I am so glad to know what other lawyers think about Bar matter 2012. A better alternative to Bar Matter 2012
Last Tuesday, April 21, 2009, being one of the faculty members of the Southwestern University School of Law in Cebu City Philippines, I was tasked by our Dean, Atty. Godwin Denzel Manginsay, to attend the Cebu City IBP forum on Bar Matter 2012. I already had a scheduled meeting with some clients, so I just submitted a position paper in behalf of our law school to our local IBP chapter. The following is what I think is a better alternative to Bar Matter 2012. For those of you who do not know what Bar matter 2012 is, it is discussed in the statement of facts, after which I gave out my argument on what I believe is a better alternative to Bar Matter 2012. STATEMENT OF FACTS Bar Matter 2012 mandates that every law practitioner is required to annually render a minimum of 60 hours of free legal aid service to indigent litigants.
